agrees when using, or accessing NetJaguar, LLC services
that the following terms and conditions of this policy
will be met:
Acceptable Usage Policy 01. User agrees to use the service in manner consistent with any and all applicable laws. In the event that this account is not used in accordance with all Applicable Laws including, but not limited to Local, State or Federal Laws, NetJaguar, LLC reserves the right to cooperate with all or any law enforcement agencies. 02 . User agrees to follow the Acceptable Use Policy of any network user connects to, including NetJaguar, LLC system. 03. Neither NetJaguar, LLC nor its Information Providers are responsible for any damages arising from User's use of nj-h.com or by User's inability to use NetJaguar, LLC service. 04. User hereby agrees that any material submitted for publication on NetJaguar, LLC through user's account(s) does not violate or infringe any copyright, trademark, patent, statutory, common law or proprietary rights of others, or contain anything obscene or libelous. Software intended to facilitate any such violations or infringements may not be stored on nj-h.com. 06. The following violations of "netiquette" are grounds for immediate suspension of service pending investigation by NetJaguar, LLC and will result in termination of the account(s) the investigation determines to have originated or transmitted these types of traffic. (a) Posting a single article or substantially similar articles to an excessive number of newsgroups (i.e. 20 or more) or continued posting of articles which are off-topic (e.g., off-topic according to the newsgroup charter or the article provokes complaints from the regular readers of the newsgroup for being off-topic). (b) Sending unsolicited mass e-mailings (i.e. to more than 25 users) which provoke (or not) complaints from the recipients. (c) Engaging in either (a) or (b) from a provider other than NetJaguar, LLC and using an account on NetJaguar, LLC as a mail drop for responses, or advertising a web site hosted at NetJaguar, LLC. (d) Continued harassment of other individuals on the Internet after being asked to stop by those individuals and by NetJaguar, LLC. (e) Impersonating another user or otherwise falsifying one's user name in e-mail, Usenet postings, on IRC, or with any other Internet service. (This does not preclude the use of nicknames in IRC or the use of anonymous re-mailer services.) 07. Users whose accounts are terminated for any of the above infractions are also responsible for the cost of labor to cleanup and respond to complaints incurred by NetJaguar, LLC. No refunds will be issued, and every subscription will be cancelled. Service Level Agreement 08. Service Level Agreement does NOT apply to customers who purchase Virtual Private Servers from NetJaguar, LLC 09. "SLA Network Violation Credit" occurs when NetJaguar, LLC guaranteed uptime is not met. NetJaguar, LLC guarantees 99.9% uptime for shared and reseller hosting offers. In order to request a credit, you have to e-mail us at This e-mail address is being protected from spam bots, you need JavaScript enabled to view it within seven (7) days from the network outage. 10. The amount of "SLA Network Violation Credit" is determined by the following table:
Please note that the SLA Network Violation Credit applies to the solar month of the downtime. Hence, the percentage is calculated on the package monthly price.
11. Credit Exclusions: Notwithstanding any contrary provision in this SLA , NetJaguar, LLC shall not be liable to reimburse in any form for failure to meet any of the guaranteed service level where such failure arises from any one or more of the following: 11.1. Scheduled downtime, maintenance, or upgrades, including without limitations the following:
- Maintenance by local public telecommunications
and telegraph service providers on access circuits
between NetJaguar, LLC and the clients’ websites 11.2. Emergency maintenance or upgrades, where such maintenance or upgrades are required by the occurrence of any events outside of NetJaguar, LLC control; 11.3. Failure of access circuits to the NetJaguar, LLC Network, unless such failure is caused solely by NetJaguar, LLC; 11.4. Erroneous SLA outages reported as a result of outages or errors of any NetJaguar, LLC measurement system; 11.5. Problems outside of NetJaguar, LLC network (upstream providers, or client’s inbound connection) not effecting 100% loss to our network, and interruptions or failures of individual service caused by Customer, Customer’s agents or employees, Customer’s clients, or other third parties, to Customer’s service. These interruptions and failures include, but are not limited to, the following:
- inaccurate configuration, 11.6. Circumstances beyond NetJaguar, LLC reasonable control and force major events including but not limited to the following: catastrophic incidents, vandalism, lightning, power failure, fire, flood, earthquake, acts of nature, emergency, acts of any governmental body, war, insurrection, sabotage, armed conflict, terrorism, embargo, riots, curfew, strike or other labor disturbance, industrial disputes, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third-party services, virus attacks, worms, Trojans, spyware, adware or other malware, failure of third-party software (including, without limitation, e-commerce software, payment gateways, chat, statistics, or free scripts) or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of this SLA; 11.7. Services or communications protocols other than hypertext transfer protocol (HTTP). 11.8. DNS (Domain Name System) issues outside the direct control of NetJaguar, LLC; 11.9. DNS propagation; 11.10. Customer’s acts or omissions (or acts or omissions of others engaged or authorized by customer), including, without limitation, custom scripting or coding, e.g. CGI, PERL, HTML, PHP, etc., any negligence, willful misconduct, or use of NetJaguar, LLC service in breach of NetJaguar, LLC Terms of Service; 11.11. Faults caused by the client’s equipment, applications, interconnected equipment, networks, systems or gateways and / or the acts or omissions of the Customer, third-party components whether within or outside NetJaguar, LLC network or the acts or omissions of local exchange carriers or failure of third party services; 11.12. Outages elsewhere on the Internet that hinder access to your account or services. NetJaguar, LLC is not responsible for browser or DNS caching that may make your Web site appear inaccessible when others can still access it. NetJaguar, LLC will guarantee only those areas considered under the control of NetJaguar, LLC; 11.13. Disconnection and / or reconnection of the services due to non-payment of any charges payable to NetJaguar, LLC or where the services are disconnected by reason of it being used for any illegal, unlawful, or other objectionable purpose described in the ToS. Acceptable Content 12. The following contents are forbidden and unacceptable on NetJaguar, LLC servers: (a) Pirated Software: anything that breaks copyright laws, including cracks, serials, warez (b) Illegal Software: tools used to infringe the above point, like cracking software (c) Illegal Pornography: even if Adult Contents are allowed, these must be completely legal. Child Pornography and any other kind of Unauthorized Contents will be reported to the authorities. (d) Illegal Audio/Video: illegal medias that go against copyright laws. (e) IRC Software: every IRC related software is banned on our servers, including bouncers and bots. NetJaguar, LLC will be the sole arbiter as to what constitutes a violation of this provision. You will be notified in time, and you'll have to remove (censor) the material we'll point out, immediately. Until the removal, your account will be suspended. If NetJaguar, LLC will need to contact you more than one time about a violation caused by you, your account will be discontinued with no refund.
13. User agrees to pay NetJaguar, LLC all charges relating to the use of User's account(s) according to rates and prices stated on said sales order at the time of commencement. 14. User is responsible for charges at the time the service is used and NetJaguar, LLC may apply the amount due to User's Paypal account at any time. 15. NetJaguar, LLC reserves the right to suspend access to service for User's account(s) upon an indication of credit problems including delinquent payments or rejection of any credit card charges. 16. Dues must be paid on a timely basis. Dues charges will continue regardless of your use unless and until you notify us via e-mail that you wish to cancel your membership at the end of your contract period. 30 days cancellation notice prior to the end of your current term is required. You can cancel your membership within your first 30 days and you will receive a full refund on your monthly fees. Domain Registration, Domain Transfer, Virtual Private Servers and Setup Fees (if any) are non-refundable! 17. Paypal payment: If Customer chooses to pay for services by Paypal, Customer grants NetJaguar, LLC the right to charge payments to that account on each due date. Customer further agrees not to challenge nor dispute any charge representing hosting payments. Agreement 18. NetJaguar, LLC may modify these terms and conditions upon notice published on the Forums and notified via eMail to Customers. User's use of NetJaguar, LLC services after such notice shall constitute User's acceptance of the modifications to this Agreement. 19. This agreement, User account, contract, and billing will automatically renew unless canceled in writing 30 days prior to the renewal date. |
